Terms of Service
[BRACKETED] placeholder.
1. Agreement
By creating an account or using Cupper (the app, cupper.ai, and related services — the "Service"), you agree to these Terms. If you use the Service for an organisation, you confirm you may bind it.
2. Eligibility
You must be at least [18 / 16] years old [or have appropriate consent] to use the Service.
3. The Service
Cupper lets you capture, digitise, review, store, and export coffee cupping and sensory score sheets and related data, and create or use scoring templates. Features may change over time.
4. Accounts
You are responsible for your account, the accuracy of your registration details, and the security of your credentials. Tell us promptly of any unauthorised use.
5. Your content and data
- You retain all rights to the data, images, templates, scores, and other content you create or upload ("Your Content").
- You grant us a limited licence to host, process, display, and transmit Your Content solely to operate and improve the Service.
- You are responsible for Your Content and for having the rights and lawful basis to upload it — including any personal data about other people (e.g., evaluator names). See Privacy Policy §8.
6. Templates and sharing
Public/standard templates are provided for convenience. Private templates you create are yours; sharing a private template creates an independent copy for the recipient. You are responsible for the templates and scoring methodologies you author.
7. Automated extraction — accuracy and your responsibility
The Service uses automated OCR/AI to extract data from score-sheet images. This output may contain errors. The Service flags uncertain values for review, but you are solely responsible for verifying extracted and computed data before relying on it. The Service assists transcription; it is not a substitute for your professional judgement, and we do not warrant the accuracy of any extracted or computed value (including scores or totals).
8. Acceptable use
You agree not to misuse the Service, including by: uploading unlawful content or content you lack rights to; infringing others' rights; attempting to breach security or access data that isn't yours; reverse-engineering the Service; or using it to build a competing product. [Adjust to your needs.]
9. Plans, payment, and cancellation
[If paid:] Paid plans are billed [terms], renewing [period] until cancelled. [Describe pricing, renewal, cancellation, refunds, and — for EU consumers — the statutory right of withdrawal and how it applies to digital services/content.]
10. Intellectual property
The Service — including the Cupper name, logo, software, and design — is owned by [LEGAL NAME] and protected by law. These Terms grant you no rights in our intellectual property except to use the Service as permitted.
11. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind to the maximum extent permitted by law. [Mandatory EU/Austrian consumer warranties cannot be excluded and prevail over this clause.]
12. Limitation of liability
To the maximum extent permitted by law, [LEGAL NAME] is not liable for indirect or consequential damages, or for loss arising from reliance on extracted or computed data. [Liability for death, personal injury, gross negligence, or intent cannot be excluded; consumer-law caps apply — have a lawyer set enforceable limits.]
13. Indemnification
[For business users:] You agree to indemnify us against claims arising from Your Content or your breach of these Terms. [Restricted or unavailable for consumers.]
14. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms or where required by law, giving notice where required.
15. Governing law and disputes
These Terms are governed by Austrian law [excluding its conflict-of-law rules]. [For consumers, the mandatory protections and courts of their country of residence are preserved; reference the EU Online Dispute Resolution platform where applicable.]
16. Changes
We may update these Terms; we will notify material changes and revise the effective date. Continued use after changes take effect constitutes acceptance where permitted by law.
